Hossein Mehjoo v Harben Barker Update - Accountants Lodge Appeal

The firm of accountants involved in the recent professional negligence case of Hossein Mehjoo v Harben Barker have confirmed that they are appealing the High Court's decision to the Court of Appeal.

The case has received a lot of attention and it will be interesting to see whether the decision is upheld.

In the meantime, it is important that all professional advisers take notice of the key focus of the decision which was that advisors should take specialist advice where they are advising on areas which are outside their normal area of expertise.

Update Spring 2014

The Court of Appeal has found in favour of the accountants confirming that they did not act negligently on the basis that Harben Barker were not "under any duty to advise the claimant of significant tax advantages which, to their reasonable knowledge, did not exist".
